Terms of Service

Welcome to Pitara Stories. These Terms of Service ("Terms") govern your access to and use of the Pitara Stories mobile application and related services (the "App") provided by Vigorpeak Solutions Private Limited ("we", "our", or "us"), a company registered in India. By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By using the App, you confirm that you are at least 18 years of age, or that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. If you are a parent or guardian allowing your child to use the App, you accept these Terms on their behalf and are responsible for their use of the App.

Children under 13 may use the App only under the supervision of a parent or guardian who has agreed to these Terms. The App is designed to be used by children, but account creation and management is restricted to adults.

2. Description of the App

Pitara Stories is a children's story application that provides illustrated stories with audio narration and read-along modes in 7 languages: English, Hindi, Kannada, Tamil, French, Spanish, and German. The App offers both free and premium (subscription-based) content. The App is designed for children and families and does not contain advertisements.

3. Subscriptions and Payments

Some content in the App is available through a paid subscription. By subscribing, you agree to the following:

• Subscription pricing and terms are displayed within the App at the time of purchase.
• Payments are processed through the Apple App Store or Google Play Store. We do not collect or store any payment information.
• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription through your device's app store settings.
• Refund policies are governed by the respective platform (Apple or Google).

4. User Accounts

Account creation is available to parents and guardians only. When creating an account, you agree to:

• Provide accurate and complete information.
• Maintain the security of your account credentials.
• Notify us immediately of any unauthorized use of your account.
• Accept responsibility for all activities that occur under your account.
• Use your account on a maximum of 3 devices. Streaming of stories is limited to one device at a time per account.

You may request deletion of your account at any time by contacting us at [email protected] or by visiting our account deletion page. Upon deletion, your personal information will be removed within 30 days in accordance with our Privacy Policy.

5. User Conduct

You agree not to:

• Use the App for any unlawful purpose.
• Reverse engineer, decompile, or disassemble the App or its content.
• Copy, distribute, or create derivative works from the App's stories, illustrations, audio, or other content.
• Attempt to gain unauthorized access to any part of the App.
• Use the App to transmit any harmful code or interfere with its operation.

6. Intellectual Property

All content in the App, including but not limited to stories, illustrations, characters, audio narrations, logos, and software, is the exclusive property of Vigorpeak Solutions Private Limited and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or use any content from the App without our prior written consent.

7. Content Availability

We strive to keep all content available, but reserve the right to add, modify, or remove stories and features at any time. We will make reasonable efforts to maintain the quality and availability of premium content for active subscribers.

8. Third-Party Platforms

The App is distributed through the Apple App Store and Google Play Store. Your use of these platforms is subject to their respective terms and conditions. We are not responsible for the policies or practices of third-party platforms.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIGORPEAK SOLUTIONS PRIVATE LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Vigorpeak Solutions Private Limited, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms. Upon termination, your right to use the App ceases immediately. Active subscriptions at the time of termination will be handled according to the respective app store's refund policies.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or our website. Your continued use of the App after changes constitutes acceptance of the revised Terms. If you do not agree with the changes, please discontinue use of the App.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vigorpeak Solutions Private Limited regarding your use of the App.
